1. Scope

For all supplies by www.buecher-zur-musik.de to consumers (according § 13 German Civil Code) apply the following terms and conditions.

You shall be deemed a consumer if you are a natural person who, when making a transaction, does not act in the course of a profession or business.

Deliveries within Germany are free of shipping costs. For deliveries abroad we charge a weight-dependent amount for shipping and handling according to the table shown here.
The amount is displayed when you proceed to checkout.

3. Offer and conclusion of the contract

3.1 The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to order . Subject to errors.

3.2 By clicking the button "Submit order" in the last step of the ordering process you make a binding contractual declaration. The contract is concluded when we accept your order by delivery or an announcement of the delivery. The automatically generated e-mail you receive after placing your order does not yet constitute an order acceptance declaration but is a mere technical confirmation of receipt of your order,

4. Wording of the contract

The wording of the contract will be stored on our internal EDP system. The Terms and Conditions can be viewed at any time on our website. The order data and the Terms and Conditions will be sent by e-mail. For security reasons, after placing your order the wording of the contract cannot be viewed on the internet by you.

5. Right to cancel

Consumers have a 14 day right of cancellation.

Cancellation policy

Right to cancel
You have the right to cancel this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date on which you or a third party named by you, which is not the carrier, have taken physical possession of the goods. This excludes e-books, for which the right of withdrawal expires once the file has been downloaded by the buyer.

by a clear statement (e.g. by letter, fax or email) of your decision to withdraw from this contract. You can use the attached withdrawal form which is not mandatory, however.

Consequences of cancellation
If you withdraw from this contract, we repay all the payments that we have received from you, including delivery costs (with the exception of the additional costs arising from the fact that you have chosen a type of delivery other than the offered standard delivery), immediately, at the latest within fourteen days from the date on which we received your cancellation of contract. For this repayment we use the same method of payment that you used for the initial transaction, unless you explicitly agreed otherwise; in any case you will not be charged fees for this repayment.

You have to return the goods promptly and in any event not later than fourteen days from the date on which you notify us of the cancellation of this contract. You will bear the cost of the return.If you cannot reimburse us in full or in part for the consideration received, or only in a deteriorated condition, you must provide us with equivalent compensation. This does not apply if such deterioration of the merchandise delivered can be attributed solely to its examination – as would have been possible at a retail location, for instance. Apart from that, you can avoid the obligation to provide compensation if you do not use the item as if you owned it, and if you refrain from doing anything which might adversely affect the value of the item.

5a. Return charges when exercising the right of cancellation
If you exercise your right to cancel, you must bear the cost of the return consignment if the goods delivered correspond to those ordered.

6. Prices and shipping charges

6.1 The prices shown in our online shop contain the statutory German VAT and other price components.

6.2 Shipping charges depend on the weight of the goods ordered and on the mode of shipment. They will be displayed clearly before submitting your order. For an overview please see Shipping charges.

7. Terms of delivery

We ship ordered goods immediately after receipt of the order. Differing delivery time details are mentioned in the tenders. The obligation to deliver shall not apply if we ourselves are not supplied correctly and on time and are not responsible for the lack of availability. In case of non availability of the goods we will inform you immediately and any advance will be refunded immediately.

We ship with German Post and DHL. You will receive a message if the shipment has left our premises.

8. Reservation of proprietary rights

The items delivered remain in our possession until paid for in full.

9. Dispute resolution

The European Commission provides a platform for online dispute resolution with further information which is reachable at https://ec.europa.eu/consumers/odr/main/?event=main.home2.show. We are neither obliged nor willing to participate in the dispute resolution procedure.

10. Privacy

Cookies
We use so-called cookies on our websites. These are small files that are stored on your computer by your browser for exchange with our system. Most of the cookies we use are deleted from your hard drive at the end of the browser session. However, there are also cookies that your browser stores on your hard drive. You can set the duration of this storage yourself in your browser.

Collection, processing and use of your data
When you visit our websites, access data is stored by us without any personal reference, such as the website from which you visit us, the type of browser you use, your Internet service provider or the products and content in which you are interested. This data is collected and evaluated in anonymous form.

Personal data such as name, address and telephone number, which we collect from you in the course of an order process, we use exclusively for the processing of your order. In the course of order processing, the service providers used by us for shipping and payment processing receive the data necessary for this. After complete processing of the contract, your data will be blocked and deleted after expiration of the tax and commercial regulations. For advertising purposes, your data will neither be used by us nor passed on to third parties.
